Welcome to Soarix, an intelligent B2B buyer-supplier discovery platform owned and operated by OpenProcure Technologies Private Limited (“Soarix”, “Company”, “we”, “our”, or “us”). This Privacy Policy explains how we collect, use, disclose, store, and protect information when you access or use our Website, platform, services, and associated applications (collectively, the “Services”). By using the Services, you acknowledge that you have read, understood, and agreed to this Privacy Policy.

Important Disclaimer

1.1 The Website and Services are provided on an “as-is” and “as-available” basis. The Company makes no representations or warranties that the Website will be error-free, uninterrupted, or free of vulnerabilities. All content on the Website is for informational and commercial facilitation purposes and does not constitute professional, legal, financial, or technical advice.

1.2 While we implement commercially reasonable security measures, no method of internet transmission, electronic storage, or data processing is completely secure. Accordingly, we do not guarantee absolute data security. Users transmit information at their own risk.

1.3 The Company shall not be liable for unauthorized access, hacking, cyberattacks, or data breaches caused by third parties, force majeure events, or circumstances beyond our reasonable control. Users are responsible for maintaining the confidentiality of their own credentials and account access.

When you access the Platform, certain information is automatically collected, including: IP address; browser type and version; device identifiers and operating system; time zone and location signals; pages visited and session duration; referring URLs; search queries and filters used; usage behaviour and interaction analytics; cookies and tracking information; crash reports and diagnostics.

Buyer & Supplier Data Practices

ℹ️This section explains specifically how Soarix handles the data of registered Buyers and Suppliers to power its core marketplace intelligence. By signing up, you consent to these practices as integral to the Platform's service delivery.

4.1 How We Use Buyer Data

  • Requirement matching: We analyse your stated procurement requirements, categories, and historical activity to surface relevant suppliers and opportunities tailored to your business needs.
  • Sharing with matched suppliers: Where you post a requirement or submit an inquiry, we may share your business name, procurement category, and relevant details with matched Suppliers to enable them to respond. You control the level of detail included in public requirements.
  • Personalised discovery: We use your browsing patterns, saved searches, and interactions to refine recommendations and highlight new relevant suppliers or categories.
  • Market intelligence: We use aggregated, anonymised buyer demand signals to generate market reports, category benchmarks, and trend insights.
  • Marketing communications: With your consent, we may send newsletters, platform updates, featured supplier spotlights, and curated opportunity alerts. You may opt out at any time via account settings or the unsubscribe link in emails.

4.2 How We Use Supplier / Vendor Data

  • Profile discoverability: Your business profile, capabilities, product/service categories, geographic coverage, and certifications are displayed on the Platform to enable Buyers to find and evaluate you.
  • Opportunity matching & lead delivery: We proactively match your profile against live buyer requirements and notify you of relevant RFQs, procurement leads, and opportunities via email or in-platform notifications.
  • Performance analytics: We provide you with analytics on profile views, inquiry volumes, shortlisting rates, and competitive positioning to help you optimise your presence on the Platform.
  • Trust & verification: Submitted credentials, references, and third-party verification data may be used to generate trust indicators displayed to Buyers.
  • Promotional features: Where applicable under your subscription plan, your profile may be featured in buyer-facing communications, category spotlights, or promotional campaigns.
  • Marketing communications: We may send product updates, platform announcements, and growth tips relevant to Suppliers. You may manage communication preferences from your account settings.

4.3 Your Control Over Data

You can update your business profile, manage notification preferences, and control visibility settings from your account dashboard. Certain data practices—such as profile discoverability and opportunity matching—are fundamental to the Platform's core service and cannot be turned off without discontinuing Platform use. To request data deletion or exercise other rights, contact support@soarix.global.

Legal Bases for Processing (GDPR)

Where applicable under the General Data Protection Regulation (“GDPR”), we process information under one or more of the following lawful bases: (i) Consent; (ii) Performance of a contract; (iii) Compliance with legal obligations; (iv) Legitimate business interests; (v) Protection of vital interests; (vi) Public interest obligations. Where consent is relied upon as the lawful basis, users may withdraw consent at any time, which will not affect the lawfulness of processing prior to withdrawal.

7.3 We do not sell personal information for monetary consideration. We do not share individual-level personal data with advertisers without consent.

International Data Transfers

Your information may be transferred to, processed in, or stored in jurisdictions outside your country of residence, including countries that may have different data protection standards. By using the Platform, you expressly consent to such international transfers. Where required by applicable law, such transfers shall be conducted using appropriate safeguards, including Standard Contractual Clauses, adequacy decisions, or other lawful transfer mechanisms recognised under applicable data protection law.

Data Retention

We retain personal data for as long as reasonably necessary to provide Services; comply with legal obligations; resolve disputes; enforce agreements; maintain business records; and protect our legal interests. We reserve the right to retain anonymised or aggregated information indefinitely. Following account closure, personal data will be deleted or anonymised within ninety (90) days, except where retention is required by law or legitimate business interest.

Data Security

We implement commercially reasonable administrative, technical, and organisational safeguards, including encryption in transit and at rest, access controls, regular security assessments, and incident response protocols. However, users acknowledge that: no security system is impenetrable; internet communications may be intercepted; and electronic storage systems may be vulnerable to sophisticated unauthorized access. We cannot guarantee complete security. In the event of a data breach affecting your rights and freedoms, we will notify affected users as required by applicable law.

User Rights

Depending on applicable law, users may have the following rights regarding their personal data:

We reserve the right to verify identity before processing requests and may deny requests that are legally permitted to be denied, excessively burdensome, or technically impractical.

India DPDP Act Compliance

ℹ️Soarix is committed to compliance with India's Digital Personal Data Protection Act, 2023 (“DPDP Act”) and applicable rules thereunder.

Where applicable under the DPDP Act: personal data shall be processed for lawful, specified purposes; Users (as “Data Principals”) may withdraw consent subject to legal or contractual restrictions, with the understanding that withdrawal may limit access to certain Services; reasonable security safeguards shall be implemented; Users may request correction or erasure of personal data; the Company shall notify affected Data Principals and the Data Protection Board in case of a significant data breach; a Grievance Officer is designated for handling privacy-related complaints within India.

Where applicable, California residents may have rights under the CCPA and CPRA, including rights to: know categories of personal information collected; request deletion; correct inaccurate information; opt out of sale or sharing of personal information; limit use of sensitive personal information; and non-discrimination for exercising privacy rights. Children's Privacy

The Platform and Services are intended for business use and are not directed toward individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that information has been collected from a minor without lawful authorization, we will delete such information. Parents or guardians who believe a minor has submitted information may contact us at support@soarix.global.

Third-Party Links & Services

The Platform may contain links to or integrations with third-party websites, logistics providers, payment platforms, and other services. We do not control and are not responsible for third-party privacy practices, security measures, or data collection. Accessing third-party services is entirely at the User's own risk. Users should independently review applicable third-party privacy policies and terms of service.

Marketing & Communications

Users may receive: service communications; transactional notices; marketing emails; promotional offers; product updates; newsletters; and curated opportunity alerts relevant to their buyer or supplier profile. Marketing communications are sent on an opt-in basis where required by law, and where we rely on legitimate interests, we provide clear opt-out mechanisms. Users may unsubscribe from marketing communications using the unsubscribe link in any email or by contacting us. Operational or service-related communications may still be sent where necessary to deliver the contracted Services.

Intellectual Property & User Submissions

Any suggestions, ideas, feedback, or content submissions provided to the Company may be used for product improvement without restriction, compensation, or attribution, unless prohibited by law, and subject to any moral rights that cannot be waived under applicable law. Users represent that they possess all necessary rights for submitted content and agree not to upload unlawful, infringing, defamatory, or harmful material.

Business Transfers

In the event of a merger, acquisition, financing, due diligence process, restructuring, bankruptcy, sale of assets, or transfer of business operations, personal information may be transferred as a business asset. In such cases, we will endeavour to notify registered users via email or a prominent notice on the Platform prior to information becoming subject to a different privacy policy. Users consent to such transfer.

Limitation of Liability

To the fullest extent permitted by law, the Company disclaims all warranties, express or implied. Services are provided “as is” and “as available”. Total aggregate liability shall not exceed the amount paid by the User to the Company in the preceding three (3) months, or ₹5,000 (Rupees Five Thousand Only), whichever is lower. Where no payment has been made, liability is limited to the minimum amount permitted by applicable law.

The Company shall not be liable for direct, indirect, special, incidental, consequential, exemplary, or punitive damages arising from use of or inability to use the Platform or Services. Some jurisdictions may not permit certain limitations; therefore, portions of this clause may not apply to all users.

Governing Law & Jurisdiction

This Privacy Policy shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India. The Company reserves the right to seek injunctive or equitable relief in any competent jurisdiction.

Changes to This Privacy Policy

We reserve the right to modify, amend, or replace this Privacy Policy at any time. Material changes will be communicated via email to registered users or through a prominent notice on the Platform prior to the effective date. Continued use of the Platform after updates constitutes acceptance of the revised Privacy Policy. We recommend periodically reviewing this page for any changes.
